Montenegro's Law on Property Relations does not restrict who may own a home. It restricts what a foreign person may own: a closed list of land types and places. Anything not on the list, which includes apartments, houses and the plots under them, a foreigner can own outright. Every foreign registration is reported to the Ministry of Finance.

What can a foreigner own in Montenegro?
Anything not on the law's restricted list, which means apartments and houses, and the building plot under them, outright. The Law on Property Relations applies to foreign persons unless a law or treaty says otherwise, and a foreign individual may inherit property on the same terms as a Montenegrin citizen.

What is on Montenegro's restricted list for foreigners?
Seven categories: natural resources; goods in general use; agricultural land; forests and forest land; cultural monuments of exceptional or special importance; real estate in the land-border area to a depth of 1 km, and on islands; and real estate in areas closed by law to foreign ownership for national interest and security reasons.
On the first six categories, a foreign person may still hold long-term lease, concession, BOT and other public-private partnership rights on the same terms as a domestic person.
Can a foreigner buy a house with land in Montenegro?
Yes, within a limit. A foreign individual may acquire agricultural land, forest or forest land of up to 5,000 m² only when the subject of the contract, whether a sale, gift or exchange, is a residential building standing on that land.
Without a residential building on it, farmland or forest stays closed to a foreign individual.
Do foreigners buy restricted land in Montenegro through a company?
Law firms describe it as the standard route: a Montenegrin company is a domestic legal person, outside the foreign-person restrictions. The statute does not itself name this route; it follows from the restrictions applying only to foreign persons.
A company-owned home has consequences: for real estate tax it always counts as a secondary residence, which municipalities can load by up to 150%. Take legal and tax advice before choosing a structure.

Who is told when a foreigner registers property in Montenegro?
The Ministry of Finance. The cadastre authority must report every registration of ownership by a foreign person to the Ministry within 15 days, and the Ministry keeps a register. A foreign owner may sell to domestic persons and to foreigners who are allowed to acquire.

What changes for EU buyers when Montenegro joins the EU?
They will have the same property ownership rights as Montenegrin nationals, under amendments Parliament adopted in March 2025, from the day Montenegro accedes. The EU negotiating chapter covering real estate was provisionally closed on 16 December 2025. No accession date is fixed.
The European Commission reported that restrictions remain on agricultural land for EEA nationals and recommended in 2025 that Montenegro remove them. The amendment does not change the position of non-EU buyers.
