Buyer's agent in Montenegro: the fee sits inside the asking price.
// Short answer
Montenegro's Real Estate Brokerage and Lease Act, in force since August 2025, sets no commission cap. The fee's amount, method and timing must be in the brokerage contract, advance fees are banned, and the asking price must be stated in a way that includes the fee. VAT is 21%. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.
Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a registered role in Montenegro?
Yes. Brokers must be entered in the register of brokers, a public electronic database kept by the economic development ministry, with agents' exam certificates and any sanctions. Anyone can request an extract, issued within three days. Firms already operating have until about August 2027 to register, so a firm missing from the register is not yet proof of anything.
Every broker must carry liability insurance of at least EUR 20,000 per claim and EUR 60,000 a year. The fee rules in full: Montenegro real estate agent fees.

Who pays the estate agent in Montenegro, and how much?
The client who signed the brokerage contract, once the deal or a qualifying preliminary contract is signed, and never in advance. The law sets no cap, but the contract must state the amount, how it is paid and when (article 18). Because the asking price must include the fee, the price you see should already cover it. VAT is 21%.

What does a buyer's agent do in Montenegro?
Finds and negotiates, and checks what a foreigner may own. Apartments and houses, with the plot under them, are open to foreigners. Agricultural land, forests, land within 1 km of the land border, islands and some protected areas are not, except up to 5,000 m² of such land when the contract's subject is a residential building standing on it.
In March 2025 Parliament gave EU nationals the same property rights as Montenegrins, but only from Montenegro's accession to the EU, and no accession date is fixed. The full list: foreign ownership in Montenegro explained.

What do the notary and the lawyer do in Montenegro?
The notarial deed is mandatory: under the Law on Notaries, a transfer of ownership of real estate not made as a notarial deed has no legal effect. A lawyer's check of the title sheet, the list nepokretnosti, comes before the main contract. On a resale the buyer files the transfer tax return and pays within 15 days, and you own the property once the cadastre entry is made.
Sources conflict on whether a foreign buyer needs a Montenegrin tax number, so confirm with the notary. Official notary, cadastre and agent fee tariffs were not found, so get written quotes. The title sheet: the list nepokretnosti explained.
