Buyer's agent in Croatia: no contract, no fee.
// Short answer
Croatia's Real Estate Brokerage Act, in force since 7 July 2026, sets no commission rate: the fee is in the brokerage contract, plus 25% VAT. An agency may not charge a buyer who signed no contract, may not take fees in advance, and must tell both sides its fees in writing beforehand. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.
Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a licensed role in Croatia?
Yes. The Croatian Chamber of Economy keeps the register of brokerage firms, which is public and online, and the directory of licensed agents, from which you can ask for an extract. Every agency must carry liability insurance of at least EUR 100,000 per claim and EUR 300,000 a year. Ask for the agency's register entry before you sign a brokerage contract.
The fee rules in full: Croatia real estate agent fees.
Who pays the estate agent in Croatia, and how much?
Whoever signed a brokerage contract, at the fee it states; the law sets no rate. An agency may charge both sides only with a separate contract with each, and the two fees together cannot exceed the highest fee in its own price list. If only one side pays, that side pays at most half. The old 6% cap was abolished in 2012.
| Rule in the 2026 Act | What it means for a buyer |
|---|---|
| No contract, no fee | An agency cannot charge a buyer who signed nothing |
| No advance fees | No fee may be taken before the deal |
| Fees disclosed in writing | Both sides are told the fee beforehand |
| Price-list cap | Applies when one agency has contracts with both sides |
One agency's FAQ, quoted on our buying page, puts agent fees at 3% plus VAT. No law sets that figure. Every cost: Croatia property buying costs.

What does a buyer's agent do in Croatia?
Finds and negotiates, then guides the sequence: an OIB tax number, checks of the land registry extract and the cadastre, often a preliminary contract with a deposit, then the main contract with the seller's signature certified by a notary. Then payment, the seller's registration consent (clausula intabulandi) and the land registry application.
The OIB comes from the Tax Administration office where the property is. What the extract shows, sheet by sheet: the Croatian land registry extract explained.

Do non-EU buyers need permission to buy in Croatia?
Yes, most do. EU and EEA citizens buy on the same terms as Croatians. Most other nationals need reciprocity between their country and Croatia plus the justice minister's prior consent for each purchase, and without that consent the contract is void. A 2025 amendment drops both tests for OECD nationals, but only from the day Croatia joins the OECD.
The ministry's table shows reciprocity met for the United Kingdom and Japan, and assessed state by state for the United States. Reciprocity is only the first test: the consent procedure still follows. As of 22 September 2026, no source showed Croatia had joined the OECD. What do the notary and the lawyer do in Croatia?
The notary (javni bilježnik) certifies the seller's signature on the main contract and reports the contract, after which the tax office assesses the transfer tax. No law requiring a lawyer was found. One agency quotes legal fees at 1% plus VAT as market practice. You become owner only on registration in the land register, which needs the seller's certified consent.

Where does independent research fit when buying in Croatia?
Before the brokerage contract. Brinkman Data analyses every listing for sale in your Croatian town and budget, checks rents against real lets, adds the transfer tax and the yearly property tax, and sends you the five worth buying with a spreadsheet of every listing. It is not an agent, takes no commission and is paid only by the buyer. $499, delivered in 5 days.
The building's age changes the tax. A resale pays 3% transfer tax on market value, charged to the buyer; a new building sold before first occupation, or within two years of it, carries 25% VAT instead. Since 2025 a yearly property tax of EUR 0.60 to EUR 8.00 per m² applies unless the home is a permanent residence or let long term. Buying gives no residence right.
The order that works: research first, then an agent to view and negotiate, then the notary, with your own lawyer if you want one. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
