Buyer's agent in the Philippines: only a licensed broker collects a fee.
// Short answer
In the Philippines only a broker licensed by the Professional Regulation Commission (PRC) may practise for a fee, and a salesperson is paid only through their supervising broker. No law sets the commission: the rate is whatever is agreed in writing, with 12% VAT for brokers above the VAT threshold. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.

Is a buyer's agent a licensed role in the Philippines?
Yes. The Real Estate Service Act (RA 9646) regulates who may practise. Practising without a PRC licence is prohibited, and a salesperson may not receive or demand a fee except through the licensed broker who supervises them. The PRC's online verification checks a licence by name or licence number. Do it before you pay any reservation fee through an agent.

Who pays the broker in the Philippines, and how much?
Whoever the written agreement says. RA 9646 defines a broker as acting for a fee or commission but sets no percentage or cap. On a pre-selling condo the developer usually deals with the agent, but you should still see in writing who pays what. Brokers above the VAT registration threshold charge 12% VAT; those below pay percentage tax instead.

What does a buyer's agent do in the Philippines?
Finds and negotiates, and should help you clear the foreign-buyer gates first. A foreigner can own a condominium unit outright, on a perpetual Condominium Certificate of Title, but never the land, and foreign ownership in a project cannot exceed 40% of total floor area. Ask for written, dated confirmation that your unit fits inside that cap.
For a pre-selling project, ask to see the developer's DHSUD License to Sell, required by Section 5 of PD 957 before units are offered. Detail: the License to Sell explained and buying a condo as a foreigner.

What do the lawyer and the notary do in the Philippines?
A licensed Philippine lawyer pulls a Certified True Copy of the CCT from the Registry of Deeds, reads the annotations on the back, and checks the developer's licensing for a pre-sell. The deed of absolute sale must be notarised, and registration is what binds third parties under Section 51 of the Property Registration Decree.
Our fee-stack page budgets about 20,000 to 40,000 pesos for notarial fees on a high-value deal, against a standard of up to about 1%. The checks in order: Philippine condo due diligence.
Can someone buy for me in the Philippines while I am abroad?
Yes, with a Special Power of Attorney. Article 1878 of the Civil Code requires a special power to acquire or transfer ownership of immovable property, and Article 1874 makes a land sale through an agent void unless the agent's authority is in writing. An SPA signed abroad can be apostilled; the Apostille Convention has been in force for the Philippines since 14 May 2019.

Where does independent research fit when buying in the Philippines?
Before the reservation fee. Brinkman Data analyses every listing for sale in your Philippine city and budget, checks rents against real lets, prices the full closing stack, and sends you the five worth buying with a spreadsheet of every listing. It is not a broker, takes no commission and is paid only by the buyer. $499, delivered in 5 days.
The closing stack alone can swing the choice. On the same 8M peso unit, our fee-stack page works the buyer-side costs at about 2.9% as a resale with capital gains tax left with the seller, against about 14.9% as a new build with VAT.
The order that works: research first, then an agent to view and negotiate, then the notary and your own lawyer. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
