Playa del Carmen: Quintana Roo agents need a state licence with a QR code

Buyer's agent in Mexico: a state licence, a registered contract, a notary.

Buyer's agent in Mexico. State licence. Notary closes. Brinkman Data brand card.

// Short answer

We found no federal rule setting a Mexican agent's commission: it is agreed between the parties, plus 16% IVA. In Quintana Roo, the state covering Cancun, Tulum and Playa del Carmen, anyone providing real estate services has needed a state licence (matricula) with a QR code to the public register since December 2025. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.

Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a licensed role in Mexico?

It depends on the state. In Quintana Roo, since the December 2025 reform, anyone providing real estate services needs a current matricula and constancia from SEDETUS, the state urban development ministry, and the matricula carries a QR code linking to the public register. Foreign agents also need immigration permission to work. Other states have their own registers.

Scan the QR code before you sign anything. The fee rules: Mexico real estate agent fees.

Who pays the estate agent in Mexico, and how much?

Whoever the agreement says. No federal rate exists that we could find, and in Quintana Roo the law says the agent receives the fees agreed between the parties. IVA at 16% applies to the fee. Nationwide, an agent's contract with a consumer must be registered with PROFECO, the consumer agency; an unregistered contract has no effect against you.

You can cancel an agent's contract within 5 business days of signing. Put the fee, the IVA and who pays it in that contract.

What does a buyer's agent do in Mexico?

Finds and negotiates, then coordinates the two steps the law requires of a foreign buyer: the SRE step (outside the restricted zone, a written agreement or statement to the SRE; inside it, the bank applies for the trust permit) and the deed signed before a notary. The SRE notes its standard permit deadline is suspended, so do not plan around a fixed number of days.

The whole process: buying property in Mexico as a foreigner.

How does the restricted zone change a purchase in Mexico?

Within 100 km of a border or 50 km of the coast, a foreigner cannot hold direct title to a home. A Mexican bank holds it as trustee under a fideicomiso permitted by the SRE, and you are the beneficiary with the use and benefit of the property. Outside that strip, a foreigner can hold title directly after a written agreement with the SRE.

Cancun, Tulum and Playa del Carmen sit on the coast, inside that 50 km strip. How it works: the fideicomiso explained.

What does the notary do in Mexico, and do I need a lawyer?

The notario público is required in practice: the transfer is formalised in an escritura pública before a notary, and tax law makes the notary calculate and pay the income tax due on the sale within 15 days. A non-resident buyer is not obliged to hold a Mexican tax number (RFC). Notary fees and the local acquisition tax (ISAI) vary; ask the notary for your municipality's figure.

A lawyer is optional and paid by you. The notary is a public officer, not the buyer's representative in the negotiation.

Where does independent research fit when buying in Mexico?

Before the agent contract. Brinkman Data analyses every listing for sale in your Mexican city and budget, checks rents against real lets, adds trust and closing costs, and sends you the five worth buying with a spreadsheet of every listing. It is not an agent, takes no commission and is paid only by the buyer. $499, delivered in 5 days.

Resale belongs in the decision from day one. A non-resident seller pays 25% of the total sale price with no deduction, or tax on the gain at the top individual rate of 35% in a sale by public deed. What you can sell for later depends on what you buy now.

The order that works: research first, then an agent to view and negotiate, then the notary and your own lawyer. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
