Is a buyer's agent a licensed role in Colombia?
Not for sales. We found no national licence for sales brokers in Colombia. A registration (matricula) is required only for rental intermediaries, under Law 820 of 2003. So a buyer's agent in Colombia is defined by the contract you sign, not by a licence. Check the person, the company and the property yourself, starting with the title certificate.
The fee rules, with the official sources: Colombia real estate agent fees.
Who pays the estate agent in Colombia, and how much?
By default, both, in equal parts, under article 1341 of the Commercial Code, unless the contract says otherwise. The fee is due once the deal is concluded. The amount is the agreed fee; without an agreement, the usual one; failing that, a fee set by experts. IVA at 19% is added. So a buyer who signs nothing about the split can owe half.
| Arrangement | Who pays | What fixes the fee |
|---|---|---|
| Contract silent on the split | Buyer and seller, in equal parts | The agreed fee, or the usual one |
| Contract names the payer | Whoever it names | The contract, plus 19% IVA |
Some guides say the seller pays 3% to 4%. Our cost page records that as a market custom, not the legal default, so agree the split in writing. Every cost: Colombia property buying costs.
What does a buyer's agent do in Colombia?
Finds and negotiates, then steers the usual sequence described by J&G Lawyers: a promise contract (promesa de compraventa) with a deposit, a title review using the Certificado de Tradición y Libertad, payment through the exchange market, the deed before a notary, registration tax and registry fees, then registration at the ORIP, the public registry.
A foreigner can own a home outright, with no prior government authorisation. Paying in foreign currency through the exchange market registers the purchase with Banco de la República as foreign investment, which protects your right to take the sale money out later. The title certificate costs COP 23,000 electronic in 2026: the certificado de tradición explained. The whole process: buying property in Colombia as a foreigner.

Do I need a notary, a lawyer or an apoderado in Colombia?
A notary, yes: the sale is an escritura pública signed before one. An apoderado, yes: under Decreto 1068 de 2015 a foreign investor must appoint one, a representative in Colombia, who can also file the Banco de la República registration if it was not automatic. A lawyer is not named as a legal requirement in the sources our pages read.
The deed then pays the departmental registration tax, set between 0.5% and 1% of the deed's value, and notary fees carry IVA. There is no VAT on new homes today, and the 2% consumption tax on property sales was struck down in 2019.

Where does independent research fit when buying in Colombia?
Before the promise contract. Brinkman Data analyses every listing for sale in your Colombian city and budget, checks rents against real lets, adds the registration tax and yearly costs, and sends you the five worth buying with a spreadsheet of every listing. It is not an agent, takes no commission and is paid only by the buyer. $499, delivered in 5 days.
Holding costs vary by city. Predial runs from 0.5% to 1.6% of the cadastral value. Rent paid to a non-resident carries 20% withholding, against a flat 35% non-resident rate. Lets under 30 days count as tourist housing and need registration in the Registro Nacional de Turismo first.
The order that works: research first, then an agent to view and negotiate, then the notary, with your own lawyer if you want one. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
