A Bali villa — what a foreign buyer can and cannot legally own in Indonesia

How to find a villa worth buying in Bali: title first, then the numbers

Find the Bali villa worth buying 69 of 780 leaseholds passed. Brinkman Data brand card.

// Short answer

Start with the title, not the photos. A foreigner cannot hold Hak Milik freehold in Bali, so the villa you buy is a Hak Pakai right of use, a 25 to 30 year leasehold, or a holding through a PT PMA company. Then run the numbers: of 780 leasehold villa listings Brinkman Data analysed, 69 passed. Brinkman Data is an independent property research service: it analyses every listing for sale in your area and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.

What can a foreigner actually buy in Bali?

Not freehold. Under the Basic Agrarian Law, Hak Milik is for Indonesian citizens only. A foreigner has three legal routes: Hak Pakai, a right of use registered in your own name at the land office; Hak Sewa, a leasehold contract registered with a notaris, usually 25 to 30 years; or a PT PMA company holding an HGB title. Nominee arrangements are not a fourth route: Indonesian courts have held them unenforceable.

RouteWhat you holdTermFits
Hak PakaiA registered right of use, in your name, at the BPN land office30 + 20 + 30 yearsOne residential villa on residentially zoned land
Hak Sewa (leasehold)A contract with the Indonesian landowner, registered with a notaris25 to 30 years, then whatever the renewal clause saysFast, cheap closings; most listings

The route decides what you can sell later and to whom. The full comparison is on Hak Pakai vs leasehold vs PT PMA and the Bali foreign-buyer guide.

What did an analysis of every Bali villa listing find?

Most leasehold villas do not earn back their lease. In October 2026 Brinkman Data analysed 949 villa-for-sale listings across nine areas of Bali. 169 were freehold, which a foreigner cannot hold. Of the 780 leaseholds, 69 passed. 643 never repay the lease from their own income before it ends, and 95 lose money every year.

How the rents were set: from the real nightly prices and live booking calendars of 3,119 Bali villas, plus yearly-let asking rents, priced at the lower end. Rerun on median rents instead, 69.5% of the leaseholds still fail.

Why so many fail: a leasehold is a clock. The rent has to repay the whole price before the term runs out, after staff, upkeep, booking fees and tax. The fewer years left on the lease, the less time the rent has to repay the price. The decay is worked through on the Bali leasehold guide.

That is the filter every Bali report runs: every villa in your area and budget, each lease tested against its own rent. You can see one real report, page by page.

What does it cost to buy a villa in Bali?

Closing costs run about 6.5% to 9% of the price on a Hak Pakai purchase and 2% to 4% on a leasehold. The largest line is BPHTB transfer tax, up to 5% of assessed value, paid by the buyer on a transfer of land rights. Then the annual layer: a staffed villa costs 8% to 14% of its value a year to run, before booking-platform fees.

How much do Bali real estate agents charge, and who pays?

Between 2% and 5% of the transaction value on a sale, and 5% to 8% on a rental, under Minister of Trade Regulation 33/2025. The fee and taxes must be itemised in a written agreement. Whoever engages the brokerage firm pays it: seller, buyer, lessor or lessee. VAT on the fee is effectively 11%.

A licensed brokerage firm is an Indonesian legal entity with a business registration number (NIB). Its brokers are Indonesian citizens with a level-6 competency certificate shown on their ID. A foreign agency can only work through a licensed Indonesian firm. A broker may take a booking fee from a buyer only with the seller's consent.

Agents do real work in Bali: finding villas, viewings, drafting the offer and coordinating the deal through to closing. On a leasehold, ask whether the lessor already pays the agent before you sign anything. Details on Bali real estate agent fees, and twenty-one countries side by side on agent fees by country.

What are the steps to buy a villa in Bali?

Shortlist, view, pull the title at the land office, choose the ownership route, check the building permit, make an offer with a deposit tied to the checks, engage your own notaris, negotiate the contract, then close and register. From offer to registered title typically runs four to twelve weeks. A PT PMA adds two to six weeks if the company does not exist yet.

  1. Shortlist six to ten villas on area, zoning, title and how you will run it.
  2. View and note neighbours, access road and new supply nearby. Sign nothing.
  3. Pull the certificate at the BPN: holder, boundary, encumbrances, zoning. Not a photocopy. See the due-diligence checklist.
  4. Choose the route: Hak Pakai, leasehold or PT PMA.
  5. Check the PBG building permit against what is built. See PBG and SLF.
  6. Offer and deposit, five to ten percent is common, released in stages as each check passes.
  7. Engage a notaris yourself, on a flat fee.
  8. Contract, and on a leasehold the renewal clause above all.
  9. Close and register: BPHTB paid, certificate reissued or lease logged.

What should a Bali leasehold renewal clause say?

Three things, in writing, before you sign. The renewal price is fixed now, as a formula or a multiple of the original price, not left to the market in 25 years. Renewal is your right, not subject to the landowner's consent. And the clause binds the landowner's heirs. A clause that misses any one of the three can end the lease at year 25.

A Bali leasehold is a contract, not a registered title. What you own is the unexpired term. If the clause works, the lease extends on agreed terms. If it does not, the land returns to the Hak Milik holder. What each version produces at the end of the term is on the Bali leasehold extension guide.

Agent, portal, research or notaris: who does what in Bali?

They are different jobs. The listing sites show what is for sale. An agent finds villas, arranges viewings and runs the deal. A notaris draws and registers the deed. Independent research decides which villa is worth buying. Brinkman Data does that last job: every villa in your area and budget analysed, the five worth buying, and a spreadsheet of every listing, for $499, paid only by the buyer.
