How to find an apartment worth buying in Berlin: district price first
// Short answer
Price a Berlin flat against what flats in its district actually sold for. Apartments sold for an average EUR 5,511 per m² in 2025, per the city's valuation committee, from EUR 3,235 in Spandau to EUR 9,374 in Mitte. Foreigners buy on the same terms as Germans. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.
Updated 19 October 2026. Prices are official sale records (Berlin and Hamburg valuation committees and France's DVF for 2025 sales, Statistics Portugal for the 12 months to March 2026, Croatia's ministry averages from 2025 sales); rules as published on the linked stanbrinkman.com research pages.

Can a foreigner buy an apartment in Berlin?
Yes. German law sets no nationality, residency or permit rule for buying residential property, and there are no quotas. A foreign buyer gets full ownership, Eigentum, of the flat and its share of the land, the same as a German buyer. Buying does not give a residence permit: immigration law is a separate question with its own rules.
The one foreign-specific rule found applies to companies, not people: a company based abroad that owns or agrees to buy German real estate must register its beneficial owners in the Transparency Register. Rules in full: buying property in Germany as a foreigner and foreign ownership in Germany, explained.

What do Berlin apartments actually sell for per m²?

Sale prices, not asking prices, after the committee's outlier cut. Köpenick's 2025 average of EUR 7,134 is lifted by a batch of micro-apartments under 30 m²; without them it is EUR 5,321. All 26 districts: Berlin price per m² by district.

How do you check whether a Berlin asking price is right?
Divide the price by the living space and compare it with the district's average and typical range. A flat far above the average needs a reason: a new build, a top floor, a renovated pre-war building. Remember these are averages, not medians, so a few expensive sales pull them up, and cellars and storage rooms are not counted in the living space.
Small samples move more from year to year: Marzahn had 45 sales in 2025 and Rummelsburg 41, so one unusual deal shifts the figure. The average flat sold had 70.9 m². In the first quarter of 2026 the committee counted 3,434 apartment sales and described prices as nearly unchanged. A district average still mixes very different buildings, which is why a report compares each listing with comparable flats nearby: see a real report, page by page.

What does it cost to buy an apartment in Berlin?
Berlin charges 6.0% land transfer tax, Grunderwerbsteuer, one of the higher state rates; Bavaria charges 3.5% and Hamburg 5.5%. Add notary and land registry fees, set by statute and published at about 1.5% to 2% of the price, or about 1.3% to 1.5% without a mortgage. If an agent is involved, the buyer's half of the commission is commonly about 3.57%.
You become owner only once the transfer tax is paid and the tax office issues its clearance certificate. The price itself must be paid by bank transfer: cash, crypto-assets and gold are not allowed, and the notary must see proof before filing the transfer. Every state rate in one table: Germany property buying costs.

How do Berlin estate agents charge?
No law sets the rate. The government's bill for the 2020 reform found customary rates of 4.76% to 7.14% of the price including VAT, with 7.14% the most common. For a flat bought by a consumer, if buyer and seller both hire the agent, each must owe the same amount, and an agent working free for one side cannot charge the other.
If only the seller hired the agent, a clause passing part of the fee to you is valid only if the seller still pays at least as much, and your share falls due only once the seller has paid. Before 2020 the buyer paid the whole commission in Berlin. Agents need a permit under section 34c of the Trade Regulation Act; there is no national public register, so ask for it. Details: Germany real estate agent fees.

What are the steps to buy an apartment in Berlin?
The notary runs it, by law. The contract is notarised and read out in full, translated if you do not speak German well enough. The notary registers a priority notice protecting your claim, collects the releases, and sends the notice that the price is due. You pay by transfer, the transfer tax is paid, and the notary applies for your entry in the Grundbuch.
An un-notarised contract to buy land is void. Buying from a developer as a consumer, you receive the draft contract two weeks before signing. If you cannot attend, a representative can act for you. Until your name is in the land register, the seller is still the legal owner: the Grundbuch, explained.

Can you let a Berlin apartment to tourists?
Only with a permit from the district office. For a secondary residence a permit is normally granted for up to 90 days of holiday letting a year, and none is granted if the applicant already has a main or another secondary residence in Berlin. Every listing must show a registration number, and fines for misuse reach EUR 500,000. Plan a Berlin investment flat as a long let.
Berlin amended its law on 31 March 2026; from 20 May 2026 platforms send host data to the authorities through a single digital system. For long lets, in areas a state designates as a tight housing market the rent at the start of a new lease may not exceed the local comparative rent by more than 10%, with designations ending by 31 December 2029; flats first let after 1 October 2014 are exempt. Check the current ordinance for your address. Global Property Guide puts Berlin's average gross yield at 4.06% for Q3 2026, from asking rents against asking prices; it is the publisher's figure, not Brinkman Data's. Agent, portals or independent research in Berlin?
Each does a different job. The portals show asking prices. A licensed agent finds flats, books viewings and handles the sale; a buyer's agent you hire searches and negotiates for you. The notary drafts the contract and controls the money. Brinkman Data decides which flat is worth buying: every listing in your districts and budget, each checked against comparable sales, the five worth buying and the spreadsheet, for $499.
Brinkman Data is not an agent, takes no commission and is paid only by the buyer. Every report is built fresh on the flats for sale that week. See a real report, the comparison on how to find a property to buy abroad, and what an independent property analyst does. Buying in Hamburg instead: how to find an apartment to buy in Hamburg.
