In Cyprus the Department of Lands and Surveys keeps the land register and issues the title deed. Because deeds can take years to issue, a buyer's first protection is the sale contract deposited at the District Lands Office within six months. For a non-EU buyer, the Council of Ministers permit decides whether the deed can be registered at all.

What is a Cyprus title deed?

The title deed is the certificate of registration issued by the Department of Lands and Surveys, which keeps the land register for the areas under the Republic's control. Transfers of ownership are declared at the District Lands Office. The registered owner on that register is the legal owner.

Before paying anything, a buyer's lawyer searches the register for encumbrances, mortgages and planning issues.

Why do you deposit the sale contract at the Lands Office?

Because a deposited contract lets you enforce the sale. Under Law 81(I)/2011, a buyer can seek specific performance only if the written, signed contract names the parties, describes the property, states the price, and is deposited at the District Lands Office within six months of signing.

Some guides describe depositing within 60 days. The statutory window is six months; the shorter figure appears to describe practice, not the law. Deposit early either way.

What is the property search certificate rule in 2026?

Under Department of Lands and Surveys notices of February and July 2026, a sale contract that is not accompanied by a property search certificate issued within five working days of signing attracts an administrative fine under Law 81(I)/2011.

The same notices say that if an undeposited contract is referred to in the tax clearance certificate (Form N.313), it must be deposited before the transfer can go ahead.

How does the Council of Ministers permit affect the title deed?

For a non-EU buyer, it decides whether the transfer can be registered. Under Cap. 109, a sale contract gives the buyer no right to acquire until permission is granted, and a registration made without it is void. Apply on form COMM 145 at the District Administration.

What happens if the title deed has not been issued?

Then the buyer holds a deposited contract, not a deed, until it is. Delays are long-standing: at a House committee in June 2023, MPs spoke of almost 100,000 buyers or owners without deeds. A usual cause is a developer's mortgage on the land, or planning issues that block issue of deeds.

Law 110(I)/2025, published on 4 July 2025, rebuilt the procedure for these "trapped buyers". As reported, it covers contracts deposited by 31 December 2014, or where a court application to deposit was filed by 31 December 2024. Ask whether separate deeds exist for the unit before you sign, and what mortgage sits on the land.

What does the transfer at the District Lands Office need?

Form N.270, the declaration of transfer; Form N.313, the tax clearance; and certificates showing municipal taxes, sewerage and water fees are paid. The buyer pays the Lands Office transfer fee, unless VAT was paid on the property. A non-EU buyer also needs the permit.
