Alicante's port: no Spanish law sets an estate agent's commission

Buyer's agent in Spain: the agreement you sign decides who they work for.

Buyer's agent in Spain. No licence. Contract decides. Brinkman Data brand card.

// Short answer

In Spain anyone may work as an estate agent: since 2000 no qualification or professional body is required, and no law sets the commission. So a buyer's agent is whoever you sign a buyer's mandate with, on the fee that mandate states, plus 21% VAT. Catalonia keeps a compulsory register of agents. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.

Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a licensed role in Spain?

Not nationally. Real Decreto-ley 4/2000 opened estate agency to anyone, with no qualification or membership of a professional body required. Catalonia is the exception that exists today: it runs a compulsory public register of agents. Andalusia's 2025 housing law makes registration compulsory there too, with the register due by January 2028. Everywhere else, the written agreement is what defines the role.

So in Spain "buyer's agent" describes a contract, not a licence. Check the company's details, and in Catalonia check the register. The full fee rules, with the official sources: Spain real estate agent fees.

Who pays the estate agent in Spain, and how much?

Whoever signs the agency agreement, at the rate it states. No law sets or caps commission, and no official source sets a custom on who pays. Our Spain cost table records that, in practice, commission is usually paid by the seller. If you sign a buyer's mandate yourself, you owe that agent's fee on its terms, with 21% VAT on top.

Ask, before the first viewing, whether the seller has already engaged the agent. Every other cost of the purchase: Spain property buying costs.

What does a buyer's agent do in Spain?

Searches the market on your instructions, arranges viewings, negotiates, and steers the purchase to completion: the private contract, often a contrato de arras with a deposit, the checks on the nota simple, then the escritura pública signed before a notary. A good one gets your NIE organised early, because you need it before you sign anything binding.

  1. NIE. Form EX-15 in Spain or at a consulate; maximum resolution time 5 days.
  2. Nota simple. The Registry extract showing the registered owner and charges.
  3. Deed. The escritura pública, signed before a notary with payment.
  4. Tax. ITP on a resale, for example 7% in Andalucía or 9% in the Comunitat Valenciana.
  5. Registration. In the Registro de la Propiedad.

Both documents explained: the nota simple and the NIE. The whole process: buying property in Spain as a foreigner.

Do I need a notary or a lawyer to buy property in Spain?

A notary, in practice yes. A lawyer, no. Only a public deed signed before a notary can be registered, and registration is what protects you against third parties. No rule requires a lawyer. You can still hire one, paid by you and independent of any agent, to read the nota simple, the charges on the property and the private contract before you pay a deposit.

A private contract binds you and the seller, but gives no Registry protection until the deed is registered. Register your own deed as soon as it is signed.

Where does independent research fit when buying in Spain?

Before the agent, not instead of one. Brinkman Data analyses every listing for sale in your Spanish city and budget, removes duplicates, checks rents against real lets, adds the purchase tax and the yearly costs of owning, and sends you the five worth buying with a spreadsheet of every listing. It takes no commission. $499, delivered in 5 days.

The yearly costs differ by owner. A non-resident pays municipal IBI and non-resident income tax every year: on the rent if the home is let, or on imputed income of 1.1% or 2% of the cadastral value if it is not, at 19% for EU/EEA residents and 24% for others. Those numbers decide which listing is worth buying.

The order that works: research first, then an agent to view and negotiate, then the notary and your own lawyer. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.

What should I ask a Spanish agent before I sign?

Four things. Who pays you? What percentage? Is the 21% VAT inside that figure or on top? Are you registered, where registration exists, as in Catalonia? Ask whether the seller has already engaged the agent before your first viewing, then read every document you are asked to sign. In Spain the agreement is the only thing that fixes your cost.

A good agent answers all four at once. The comparison across twenty-one countries: real estate agent fees by country.

Whoever signs the agency agreement. No Spanish law sets a commission rate or a rule on who pays; the agreement decides, and 21% VAT applies to the fee.
Are real estate agents licensed in Spain?

Is a lawyer required to buy property in Spain?
No rule requires a lawyer. A notary is needed in practice, because only a public deed can be registered at the Property Registry, and registration is what protects the buyer against third parties.
