Alicante's port: no Spanish law sets an estate agent's commission

Spain real estate agent fees: no legal rate, 21% VAT on top.

Agent fees in Spain. No legal rate. 21% VAT. Brinkman Data brand card.

// Short answer

Spain sets no rate and no cap on estate agent commission. Since 2000 anyone may work as an estate agent without a qualification or membership of a professional body, so the fee and who pays it are whatever the agency agreement says. VAT at 21% is charged on the agent's fee. Catalonia runs a compulsory register of agents today; Andalusia's 2025 housing law makes one compulsory too, to be set up by January 2028.

How much does a Spanish estate agent charge?

No law sets it. Estate agency in Spain has been open to anyone since 2000, with no qualification or association membership required, so the commission is a matter of contract.

That makes the written agreement the only thing that fixes your cost: the percentage, whether VAT is included, and when it is due. Every other cost of the purchase: Spain property buying costs.

Who pays the estate agent in Spain, buyer or seller?

Whoever signs the agency agreement. No official source sets a custom, so ask before you view whether the seller has already engaged the agent, and read anything you are asked to sign.

If you sign a buyer's mandate with an agent, you owe their fee on the terms of that mandate.

Is VAT charged on agent fees in Spain?

Yes. Spain's standard VAT rate is 21%, and it applies to the agent's fee.
