Panama City: real estate brokers need a Junta Tecnica licence

Buyer's agent in Panama: a licensed broker, checkable online.

Buyer's agent in Panama. Licensed broker. 7% ITBMS. Brinkman Data brand card.

// Short answer

In Panama a real estate broker needs a licence from the Junta Tecnica de Bienes Raices, a B/.10,000 bond renewed every year and an exam, and anyone can check a broker in MICI's online list. No law sets the rate: unless agreed otherwise, whoever hired the broker owes the prevailing market commission, plus 7% ITBMS. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.

Is a buyer's agent a licensed role in Panama?

Yes. Practising needs a Junta Tecnica licence, a B/.10,000 bond renewed every year, and an exam. Foreign applicants need five years' residence, and brokering without a licence carries a B/.10,000 fine. Search the broker by name in MICI's online list of licensed real estate brokers before you sign anything.

The fee rules in full: Panama real estate agent fees.

Who pays the estate agent in Panama, and how much?

Whoever hired the broker, unless agreed otherwise: Decree Law 6 of 1999, article 15, presumes that party owes the prevailing market commission. The brokers' Code of Ethics sets an optional minimum of 5% on sales, and Global Property Guide reports the usual 3% to 5% agent fee is paid by the seller. ITBMS of 7% applies once the broker bills over B/.36,000 a year.

So if you hire a broker to search for you, agree in writing who pays and what. Every other cost: Panama property buying costs.

What does a buyer's agent do in Panama?

Finds and negotiates, and first confirms what is for sale: a registered finca or only possession rights (derechos posesorios). Titled property is a finca in the Registro Público, and registration perfects ownership. A possession right is a claim to occupy land that is not formally titled, and the buyer's position depends on later titling succeeding.

How the register works: the Panama public registry explained.

What do the lawyer and the notary do in Panama?

A lawyer runs the title search at the Registro Público for liens, debts and condo association arrears before the promissory contract (promesa de compraventa) and its deposit. Closing is a public deed signed before a Panamanian notary, and ownership transfers when the deed is registered. Global Property Guide quotes legal fees of about 2% and notary fees of about 0.10%.

The 2% transfer tax is legally the seller's, though contracts can allocate it differently, and the seller's capital-gains tax must be paid before the sale is registered. Banks will ask you for a passport, a tax ID and a source-of-funds affidavit. The full process: buying property in Panama as a foreigner.

Where does independent research fit when buying in Panama?

Before you hire a broker. Brinkman Data analyses every listing for sale in your Panamanian city and budget, checks rents against real lets, adds closing and yearly costs, and sends you the five worth buying with a spreadsheet of every listing. It is not a broker, takes no commission and is paid only by the buyer. $499, delivered in 5 days.

Two rules shape the numbers. Property tax is 0% on the first B/.30,000 of cadastral value, then 0.60%, 0.80% and 1.00% bands. In the District of Panama, leases shorter than 45 days are prohibited unless the property holds authorisation as public tourist lodging.

The order that works: research first, then an agent to view and negotiate, then the lawyer and the notary. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
