Buyer's agent in Malaysia: registered, and capped at 3%.
// Short answer
Malaysia's estate-agent board, LPEPH, caps the fee for selling or buying land and buildings at 3% of the price, with a minimum of RM1,000, and runs a public search of registered agents. The client who appoints the agent pays, and agents registered for service tax add 8%. New developer launches are by agreement. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.
Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a registered role in Malaysia?
Yes. Estate agents are registered with the Board of Valuers, Appraisers, Estate Agents and Property Managers (LPEPH, formerly LPPEH), which runs a public members search by name or registration number. Check the agent there before you sign an appointment letter. A buyer's agent is a registered agent you appoint yourself, in writing.
The fee rules in full: Malaysia real estate agent fees.

Who pays the estate agent in Malaysia, and how much?
The client who appoints the agent. The Board's scale refers only to the agent's client and does not say buyer or seller, so the appointment letter decides. The cap is 3% of the price, minimum RM1,000 per property. Project sales by registered agents are by agreement, and the scale does not cover Malaysian property sold abroad, for example at an overseas property fair.
Worked on an RM1,000,000 condo: up to RM30,000, plus 8% service tax of RM2,400 if the agency is registered for it. Registration applies above RM500,000 of taxable services in 12 months, so a small agency may not charge it. Every cost at transfer: Malaysia property buying costs.

What does a buyer's agent do in Malaysia?
Finds and negotiates within the rules a foreign buyer meets first. Every foreign purchase needs the prior written approval of the State Authority, and a dealing without it is null and void. Each state sets a minimum price: RM1,000,000 is the common figure, but published residential floors run roughly RM400,000 to RM3,000,000. A useful agent shows you only stock you can buy.
- Closed nationally: low-cost and medium-low-cost units, Malay Reserved Land, and units allocated to Bumiputera interests in a development.
- Selangor: strata and landed-strata titles only.
- Perak: no freehold for non-citizens since September 2023.
- Melaka: at most 2 residential units.
Every state row is stated as at October 2024: Malaysia minimum purchase price by state.

Who does the legal work in a Malaysian purchase?
Solicitors. There is no civil-law notary step in a Malaysian purchase: solicitors do the transfer and the state consent filings, on fees set by the Solicitors' Remuneration Order 2023, 1.25% on the first RM500,000 (minimum RM500) and 1% on the next RM7,000,000. Title passes when the transfer is registered, not on payment.
State consent can carry conditions and a levy, and the levy must be paid within thirty days of the approval notice or the approval lapses. No published processing time was found. Most apartments sit on a strata title: the strata title explained.

Where does independent research fit when buying in Malaysia?
Before the appointment letter. Brinkman Data analyses every listing for sale in your Malaysian city and budget, sets aside what a foreigner cannot buy there, checks rents against real lets, adds stamp duty and holding costs, and sends you the five worth buying with a spreadsheet of every listing. No commission, paid only by the buyer. $499, delivered in 5 days.
From 1 January 2026 a foreign buyer of residential property pays a flat 8% transfer stamp duty on the higher of price and market value. On sale, real property gains tax for a foreign seller is 30% within five years and 10% from the sixth, and the buyer retains up to 7% of the price for the tax authority.

What should I ask a Malaysian agent before I sign?
Five things. What is your LPEPH registration number? Who is your client on this property? What percentage, within the 3% cap, and is 8% service tax on top? Is this a developer project sale, where the cap does not apply? Does this unit clear the state's minimum price and exclusions for a foreign buyer? Get the answers in the appointment letter.
The twenty-one-country comparison: real estate agent fees by country. What a foreigner can own: buying property in Malaysia as a foreigner.
