Malaysia strata title, explained: what an apartment owner actually holds.

The owner's documents are a register document of strata title in Form 4 and an issue document with the certified strata plan attached. Registration, not the contract, is what vests ownership. What is a strata title in Malaysia?
It is the individual title to one parcel inside a subdivided building or land, issued under the Strata Titles Act 1985 [Act 318]. The Act facilitates the subdivision of a building or land into parcels and the disposition of titles to them. The Registrar prepares and maintains a strata register consisting of a series of books, one book per lot.
So strata covers more than apartments. A condominium unit, a flat, a service apartment and a landed house inside a gated strata scheme can all sit on strata titles, which is why the phrase landed strata appears in the state rules for foreign buyers.
One caveat on the text. The public reprint of Act 318 that was read for this page incorporates amendments only up to 1 January 2006, and the Act was substantially amended afterwards, including alongside the Strata Management Act 2013. The section numbering cited here is stable, but check the detail against a current reprint before you rely on it.
What documents does the owner of a Malaysian apartment hold?
Two. Under section 16(1) and (2) of the Strata Titles Act the Registrar prepares, for each parcel, a register document of strata title in Form 4, and an issue document of strata title consisting of a copy of the register document with the certified strata plan attached, plus a copy of the Form 3 statement where appropriate.
The issue document is the owner's copy. The register document is the record held at the registry. Registration consists of authentication under the hand and seal of the Registrar, and the date of registration is inscribed on every document, so the date you became the registered proprietor is on the face of the title (section 16(5)).
The wider register works the same way. Under the National Land Code a register document of title is the document registered at the land registry that evidences title, and an issue document of title is a copy of, or extract from, it prepared for issue to the proprietor. The owner's copy is never the original record.

What is the master title, and when does a unit leave it?
The master title is the title to the whole lot before strata titles issue. On authenticating the Form 3 statement for a book of the strata register, the Registrar endorses a memorial on the lot's title recording that the book is open and that the common property is vested in the management corporation.
The issue document of the master title is returned to that management corporation, and after that no entry is made on either document of title to the lot except one affecting the common property (section 17(1) and (2)). In other words the master title stops being the place a unit's dealings are recorded once the strata titles have issued.
That matters on a new development. If strata titles have not yet issued, you are dealing against the master title, and in Melaka the published state rules expressly permit a foreign buyer to acquire master-title property without separate strata titles only subject to State Authority approval. Ask which title exists today, not which is planned.

What are share units, and why do they matter?
Share units are the parcel's allotted share of the scheme, shown in the schedule of share units in the approved strata plan. Aggregate share units is their sum. Share units drive voting weight and the share of common expenses, so they are a number you read off the strata title, not off a service-charge invoice.
Check the aggregate figure too, because of provisional blocks. A provisional block is a future phase shown on the approved strata plan with provisional share units allotted to it, and the Act contains a bar on dealing in a provisional block. In a phased scheme the aggregate share units already account for that future phase, so your own percentage is set with it included.
Service charge and sinking fund levels themselves are set per scheme by share units under the Strata Management Act 2013 regime. No published national average was located from an official source, so no ringgit per square foot figure appears on this page.
Does the contract or the registration give you ownership?
Registration. Under section 340(1) of the National Land Code the title or interest of any person registered as proprietor is indefeasible, and under section 215(2) the transferor's title passes to and vests in the transferee upon registration of the transfer. Transfer is effected by Form 14A. Paying is not owning.
- Indefeasibility is not absolute. Section 340(2) excepts fraud or misrepresentation to which the registered party or its agent was party or privy, registration obtained by forgery or by an insufficient or void instrument, and title unlawfully acquired in the purported exercise of a statutory power. Section 340(3) protects a subsequent purchaser in good faith for valuable consideration.
- You take what the register says. The transferee takes subject to any subsisting registered lease or charge, certain unregistered tenancies, all conditions and restrictions in interest, and everything else appearing on or referred to in the register document of title. That is what a title search is for.
- Adverse possession does not run against a registered proprietor (section 341), and the Limitation Act 1953 cannot extinguish a title or interest in land.
- Qualified title exists. It is title issued in advance of survey, so on a new development you can be dealing with a title that has not been finally surveyed.
Why does the title type matter more for a foreign buyer in Malaysia?
Because in several states it decides both what you may buy and what you must pay. Selangor permits a foreign buyer strata and landed-strata titled properties only and does not permit landed individual titles. Melaka's published strata floor is RM500,000 against RM1,000,000 for landed, including landed strata. Both figures are stated as at October 2024.
Negeri Sembilan splits the same way, at RM600,000 and above for strata against RM1,000,000 and above for landed strata and landed. Perak's developer bands are also quoted separately for strata and for landed. So the first question on a Malaysian purchase is not the price. It is which title the unit sits on.

One more thing a strata scheme controls. On 5 October 2020 the Federal Court upheld a management corporation's house rule prohibiting use of residential units for business including short-term rental, holding that section 120 of the National Land Code and section 70 of the Strata Management Act 2013 can be read harmoniously and that the State Authority's conditions of use on the title do not stop a management corporation making further rules. The scheme's own by-law can close short-term letting regardless of any licence.
