Cap Cana marina: no Dominican law sets an estate agent's commission

Buyer's agent in the Dominican Republic: the written agreement sets the fee.

Buyer's agent, Dominican Rep. No licence law. 18% ITBIS. Brinkman Data brand card.

// Short answer

We found no Dominican law that sets an estate agent's commission or requires agents to hold a licence; a bill to create a licensing association sits in the Senate archive. The fee is whatever you agree in writing, plus 18% ITBIS, and agents handling transactions fall under the anti-money-laundering law. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.

Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a licensed role in the Dominican Republic?

No licensing law in force was found. A bill to create a Dominican association of real estate brokers, with compulsory licences, is in the Senate archive, with no sign it has been enacted. Agents are regulated another way: those involved in transactions for clients are obliged entities under anti-money-laundering Law 155-17, supervised by the tax authority, the DGII.

So expect identity checks and questions about the source of your funds; they are a legal duty, not a delay. The fee rules: Dominican Republic real estate agent fees.

Who pays the estate agent in the Dominican Republic, and how much?

Whoever the written agreement says: the official legislation database shows no enacted law setting or capping commission. In practice, Global Property Guide reports an agent fee of 2% to 3%, paid by the seller. If you sign a buyer's agreement yourself, you owe the fee it states, plus 18% ITBIS on taxable services.

Higher commission figures sometimes quoted online were not found in any source our cost page reviewed. Every cost line: Dominican Republic property buying costs.

What does a buyer's agent do in the Dominican Republic?

Finds and negotiates, and checks the title type early. Ownership of an individual parcel is proven by a Certificado de Título. Older rights may sit on a Constancia Anotada, a share of a parcel with no individual cadastral designation, converted to a title by a boundary survey called a deslinde. The listing does not always say which one is on offer.

Before paying, order the registry's Certificación del Estado Jurídico del Inmueble: it shows every current lien, mortgage and annotation. The standard fee is RD$1,000 and anyone can request it. A foreigner buys on the same terms as a Dominican, with no purchase permit for an ordinary home. Detail: the certificado de título explained.

What do the notary and the lawyer do in the Dominican Republic?

A notary must certify the deed under Law 140-15; the registry accepts a private deed with notarised signatures or a notarial deed. A lawyer is described as standard practice through registration, not a legal requirement. Published fees: legal fees of 1% (Global Property Guide) or 1% to 1.5% (DR Listings), and notary fees of 0.25% to 1%. Get written quotes.

A foreign buyer identifies with a passport plus a second national ID from home. The registry needs the seller's duplicate title, a DGII certificate that the annual property tax is paid or exempt, and proof the transfer tax is paid. The whole process: buying property in the Dominican Republic as a foreigner.

Where does independent research fit when buying in the Dominican Republic?

Before the agreement you sign. Brinkman Data analyses every listing for sale in your Dominican city and budget, checks rents against real lets, adds the transfer tax and yearly costs, and sends you the five worth buying with a spreadsheet of every listing. It is not an agent, takes no commission and is paid only by the buyer. $499, delivered in 5 days.

The tax line differs by project. The 3% transfer tax is due within 6 months of the transfer, but first purchasers in a CONFOTUR-classified tourism project are exempt, and a later buyer does not inherit that. The annual IPI is 1% of an individual's real estate value above RD$10,695,494 in 2026.

The order that works: research first, then an agent to view and negotiate, then the notary and your own lawyer. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
