Buyer's agent in Bali: 2% to 5%, paid by whoever signs.
// Short answer
In Bali a buyer's agent must work through a licensed Indonesian brokerage firm. Under the trade ministry's 2025 rules the sale commission is 2% to 5% of the transaction value, itemised in a written agreement and paid by whoever engages the firm, buyer or seller. VAT on the fee is effectively 11%. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.
Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a licensed role in Bali?
Yes, through a firm. Under Minister of Trade Regulation 33/2025 a property brokerage firm must be an Indonesian legal entity with a business registration number (NIB) and must display its permit number. Its brokers must be Indonesian citizens with a level-6 competency certificate shown on their ID. A foreign agency can only broker through a licensed Indonesian firm.
Ask for the firm's NIB and the broker's certificate number before the first viewing. The fee rules in full: Bali real estate agent fees.
Who pays the estate agent in Bali, and how much?
Whoever engages the firm. The regulation names the seller or owner, the buyer, the lessor or the lessee as possible clients and does not assign the fee to one side. On a sale the commission is at least 2% and at most 5% of the transaction value, scaled to the services provided, and 5% to 8% on a rental. VAT is 12% charged on 11/12 of the fee, effectively 11%.
| Arrangement | Who pays | What the rules say |
|---|---|---|
| Firm engaged by the seller or lessor | The seller or lessor | Their written agreement |
| Firm you engage as buyer | You | 2% to 5% on a sale, itemised in writing, plus VAT |
| Booking fee or deposit taken from a buyer | Held for the deal | Allowed only with the seller's consent |
On a leasehold villa, check whether the lessor already pays the agent before you sign anything. Every other cost of a Bali deal: the Bali villa fee stack.

What does a buyer's agent do in Bali?
Finds and negotiates, and in Bali helps you buy the right kind of title. Hak Milik, Indonesian freehold, is reserved for Indonesian citizens by the Basic Agrarian Law of 1960. A foreigner holds a different, defined right: Hak Pakai in their own name, Hak Sewa (a lease), or Hak Guna Bangunan (HGB) held through a PT PMA company. The certificate header says which one is for sale.
- Hak Pakai. A registered right to use. On State land it runs up to 30 years, extendable by 20 and renewable by 30 (Government Regulation 18 of 2021).
- Hak Sewa. A lease contract made before a notaris, with no land-office transfer.
- HGB through a PT PMA. Since BKPM Regulation 5/2025 the company pays in at least IDR 2.5 billion of share capital, inside a declared investment above IDR 10 billion.
The routes side by side: foreign ownership in Bali. The whole sequence: the Bali villa buying process.

What do the notaris and the PPAT do in Bali?
A PPAT, the land deed official, draws the Akta Jual Beli (AJB), the deed that transfers a registered land right. Without it the transfer cannot be registered. The PPAT checks the certificate at the Land Office first and must lodge the signed deed within 7 working days. A lease, or a preliminary contract (PPJB), is made before a notaris instead and moves no land.
Two taxes gate the signature. The buyer pays BPHTB, at most 5% under Law No. 1 of 2022, with the operative rate and a non-taxable threshold of at least Rp 80,000,000 set by the region. The seller pays a final 2.5% income tax on the transfer. Both receipts must exist before the deed is signed. Lodging the deed does not put your name on the certificate: that step, balik nama, is yours. Detail: the AJB explained.

Where does independent research fit when buying in Bali?
Before the booking fee. Brinkman Data analyses every listing for sale in your Bali area and budget, checks rents against real lets, notes which title each listing carries, adds the closing taxes, and sends you the five worth buying with a spreadsheet of every listing. It is not an agent, takes no commission and is paid only by the buyer. $499, delivered in 5 days.
The title changes what a fair price is. A Hak Sewa lease runs down year by year; a Hak Pakai on State land can run about 80 years on paper; an HGB comes with a company's yearly overhead. On developer stock, a PPJB is only permitted once construction has reached at least 20%, and the buyer gets at least seven working days to study it.
The order that works: research first, then an agent to view and negotiate, then the notaris or PPAT. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.

What should I ask a Bali agent before I sign?
Four things. Is your firm licensed, with an NIB, and do you hold a competency certificate? Who is your client on this villa, the seller or me? What percentage, inside the 2% to 5% band, and is the VAT on top? What title does the property carry: Hak Milik, Hak Pakai, HGB or a lease? Get every answer in writing before any money moves.
Why research and brokerage are different jobs: Bali villa research vs an agent. The comparison across twenty-one countries: real estate agent fees by country.
