Hamburg's Speicherstadt: since 2020 a German home buyer pays at most half the agent's commission

Buyer's agent in Germany: a home buyer pays at most half.

Buyer's agent in Germany. 34c permit. Buyer pays half max. Brinkman Data brand card.

// Short answer

Anyone brokering property commercially in Germany needs a permit under section 34c of the Trade Regulation Act. No law sets the commission, but since December 2020, when a consumer buys a flat or a house, the buyer pays at most what the seller pays. The government's 2019 bill found 4.76% to 7.14% customary, VAT included. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.

Is a buyer's agent a licensed role in Germany?

Yes, in the sense that matters. Anyone who brokers property commercially needs a permit from the local authority under section 34c of the Trade Regulation Act (GewO). There is no national public register, so ask the agent for the permit. The brokerage contract itself must be in text form, and an email is enough.

Who pays the estate agent in Germany, and how much?

For a flat or single-family house bought by a consumer, the law splits it. If buyer and seller both hire the agent, each owes the same amount, and an agent working free for one side cannot charge the other (BGB section 656c). No law sets the rate. The 2019 government bill found local customs of 4.76% to 7.14% of the price, VAT included, with 7.14% the most common.

ArrangementWho paysThe rule
Both sides hire the agentBuyer and sellerThe same amount each (section 656c)
Only the seller hired the agentMostly the sellerA buyer share is valid only if the seller pays at least as much, and falls due after the seller has paid (section 656d)
Agent works free for the sellerNobody elseThe agent cannot charge the buyer (section 656c)

VAT is 19%, which is why 6% net reads as 7.14% gross. Our cost page puts the buyer's half commonly at about 3.57%. Every cost: Germany property buying costs.

What does a buyer's agent do in Germany?

Searches, arranges viewings and negotiates, then the notary takes over the legal side. Before 2020 the buyer paid the whole commission in Berlin, Brandenburg, Bremen, Hamburg, Hesse and parts of Lower Saxony; the reform changed who pays, not the rate. So ask, before the first viewing, who has hired the agent and what share you will owe.

  1. Notarised contract. A contract to buy land must be notarised, or it is void.
  2. Priority notice. The notary registers an Auflassungsvormerkung to protect your claim.
  3. Price due. The notary tells you when to pay, by bank transfer; cash, crypto and gold are not allowed.
  4. Registration. Once the transfer tax is paid, the notary applies for your entry in the Grundbuch.

You become owner only on that entry: the Grundbuch explained.

What does the notary do in Germany, and do I need a lawyer?

The notary is required: a contract to buy land must be notarised or it is void (BGB section 311b). The notary checks the Grundbuch, drafts the contract and reads it out in full, translated if your German is not good enough. Buying from a developer as a consumer, you get the draft two weeks before signing. No rule requires a lawyer as well.

Notary and land registry fees run about 1.5% to 2% of the price. You can still hire a lawyer, paid by you, to read the draft in those two weeks. If you cannot attend the signing, a representative can act for you.

Can a foreigner buy property in Germany?

Yes, on the same terms as a German. Germany has no nationality, residency or permit rule for buying residential property, and the buyer gets full ownership of land and building. The one foreign-specific rule found applies to companies: a company based abroad that owns or agrees to buy German real estate must register its beneficial owners in the Transparency Register.

Buying gives no residence right. The full process: buying property in Germany as a foreigner.

Where does independent research fit when buying in Germany?

Before the first viewing. Brinkman Data analyses every listing for sale in your German city and budget, checks rents against real lets, adds your state's transfer tax and the commission split, and sends you the five worth buying with a spreadsheet of every listing. It is not an agent, takes no commission and is paid only by the buyer. $499, delivered in 5 days.

The state moves the total. Transfer tax runs from 3.5% in Bavaria to 6.5% in states such as NRW and Brandenburg, with Berlin at 6.0%. Where a state has designated a tight housing market, a new lease is capped at 10% above the local comparative rent. A gain on sale is tax-free after 10 years.

The order that works: research first, then an agent to view and negotiate, then the notary. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
