Buyer's agent in France: the fee is on the advert, and paid after the deed.
// Short answer
French estate agents must hold a carte professionnelle and show its number on every document. Fees are not capped, but the maximum must be displayed, every sale advert must say who pays, and nothing can be demanded before the final deed is signed at the notaire. A buyer's agent is an agent working under a search mandate you sign. Brinkman Data is an independent property research service: it analyses every listing for sale in your city and budget and sends you the five worth buying, with a spreadsheet of every listing. Not an agent, no commission, paid only by the buyer. $499, delivered in 5 days.
Updated 19 October 2026. Agent rules and fees as of October 2026 and buying rules as of September 2026, as published on each country's pages on stanbrinkman.com.

Is a buyer's agent a licensed role in France?
Yes. Anyone acting as an estate agent in France must hold a carte professionnelle issued by the chamber of commerce and industry (CCI) and show its number on every document. That applies whether the mandate comes from the seller or from you. Ask for the number and check it against the CCI's register of property professionals before you sign a search mandate.
The fee rules, with the official sources: France real estate agent fees.
Who pays the estate agent in France, and how much?
The mandate decides, and the advert tells you. Fees are not capped: the agency displays its maximum fees including tax, and you can negotiate below them. Every sale advert states how the fee is split. Where the buyer pays, the advert shows the fee as a percentage of the price excluding fees, with the fee-inclusive price first. VAT at 20% is inside the displayed figure.
So in France the split is printed on the listing before you call. Our cost page found no verified typical percentage, so compare the displayed figures: France property buying costs.

When is a buyer's agent paid in France?
Only after the deal is done. No money may be demanded before the sale is concluded, and commission is paid after the final deed is signed before the notaire. Breaking this rule is a criminal offence. So an agent working under your search mandate is paid on completion, and a buyer who walks away before the deed has paid no advance.
The deed that triggers payment: the acte authentique explained.
What does a buyer's agent do in France?
Searches under your mandate, arranges visits, negotiates the price, and guides you to the pre-contract, a compromis de vente or promesse unilatérale de vente, with the seller's diagnostics file annexed, including the DPE energy rating. A private buyer of a home then has a 10-day cooling-off period before moving on to the acte authentique at the notaire.
If the purchase is financed, the pre-contract normally carries a loan condition of at least one month. The full process: buying property in France as a foreigner.

What does the notaire do, and do I need a lawyer?
The notaire is required: only a notarial deed, the acte authentique, can be published in the land register. The notaire holds the deposit of around 5% to 10% in escrow, collects transfer duty of about 5.81% or 6.32% on a resale depending on the department, and examines your nationality, residence and matrimonial regime. The notaire does not choose the property for you.
The notaire's own fee follows a regulated sliding scale plus 20% VAT. A lawyer is optional and paid by you. Department rates and the scale: France property buying costs.

Where does independent research fit when buying in France?
Before the search mandate. Brinkman Data analyses every listing for sale in your French city and budget, checks rents against real lets, adds transfer duty and the yearly taxes, and sends you the five worth buying with a spreadsheet of every listing. It is not an agent, takes no commission and is paid only by the buyer. $499, delivered in 5 days.
French holding costs vary by commune. Taxe d'habitation still applies to second homes, with a surcharge of up to 60% possible in zones tendues, and IFI, the real-estate wealth tax, applies above EUR 1.3 million of net French real estate.
The order that works: research first, then an agent to view and negotiate, then the notary and your own lawyer. The full comparison: how to find a property to buy abroad. What an independent analyst does: independent property analyst. A real report, page by page: the sample report.
