Yes. An American can own a Portuguese home outright, land and building, on the same terms as a Portuguese citizen, with no nationality test and no permit. Two things most American buyers still get wrong: property has not qualified for a golden visa since October 2023, and the IRS follows the asset.

Can Americans buy property in Portugal?

Yes. Foreigners can buy residential property in Portugal, land and building, freehold, on the same terms as Portuguese citizens. There is no nationality or residency test, no approval and no quota. The one document you need before anything else is a NIF, the Portuguese tax number, which any foreigner can request.

Title is recorded in the Land Registry, the Registo Predial. The certificate to read is the certidao permanente, which shows the owner, the description and charges such as mortgages. The deed can be completed in one sitting at the Ministry of Justice's Casa Pronta counter, which handles every formality for a purchase including the mortgage registration, and where the seller posts a EUR 15 online notice so public bodies with a right of first refusal can say whether they will use it.

Does a Portuguese house get an American a visa or a tax break?

No to both, and this is where American buyers are most often working from 2022 information. The golden-visa routes based on buying or rehabilitating real estate were closed by the Mais Habitacao law in force 7 October 2023. Separately, the non-habitual resident regime closed to new entrants from 1 January 2024.

The replacement regime, IFICI, is not a retirement or investor scheme. It taxes qualifying Portuguese employment and self-employment income at a flat 20% for ten years and is restricted to listed activities: higher-education teaching and research, qualified roles in innovation centres, highly qualified professions at qualifying exporting companies, certified start-ups and similar. It is not available to passive investors or retirees, or to anyone who has had the old regime.

Existing golden visas granted under the old rules can still be renewed, and fund, company, job-creation, research and cultural-heritage routes remain open. None of them is a property purchase. Short stays in the Schengen area are up to 90 days in any 180-day period.

Does the IRS follow a Portuguese property?

Yes. The United States taxes its citizens and green-card holders on worldwide income wherever they live, so rent from a Portuguese property is reportable at home as well as taxed in Portugal. Foreign financial accounts and certain foreign assets carry their own reports on top of the return itself.

This page states that the obligations exist. It does not tell you how Portuguese tax already paid interacts with your US return, and neither does the person selling you the apartment. Take it to an adviser who handles both sides.

What does an American pay on Portuguese rental income?

A flat 25% on residential rent, the autonomous rate for non-residents, with no option to switch to the progressive rates because that option is limited to residents of another EU or EEA state. Longer leases reduce it: minus 10 points for 5 to 10 year contracts, minus 15 for 10 to 20, minus 20 for 20 or more.

Non-residents declare Portuguese rental income on the annual IRS return, and where the tenant is an entity with organised accounts it withholds 25% of the gross rent as an advance payment. Tax is charged on net income after deductible expenses.

Also decide your representation. A non-resident must appoint a tax representative resident in Portugal, a duty waived for anyone who signs up for electronic notifications, and a resident outside the EU and EEA must appoint a representative before cancelling those electronic services. What does the purchase itself cost, and what does it cost to hold?

On the way in: IMT in bands from 1% to 8% on a second home up to EUR 633,931, then a flat 6% on the whole price up to EUR 1,150,853 and a flat 7.5% above, plus 0.8% stamp duty. No VAT on a home. Yearly: IMI at 0.3% to 0.45% of the tax value, plus AIMI above EUR 600,000.

What happens to the gain when an American sells?

Since 2023 only 50% of a non-resident's gain on Portuguese real estate is counted, and that half is aggregated and taxed at the general progressive rates, which for 2026 run from 12.5% to 48% above EUR 86,634. The band is set using the seller's worldwide income, on the same basis as for a resident.

That worldwide-income test is the part that hurts an American with a large domestic salary. Half the gain sounds generous until the band it lands in is set by income Portugal never taxed. Run the number before you buy, not in the year you sell.
